Introduction
These general conditions of sale are intended to govern the contractual relationship between the company "aperosympa.fr" and the customer defined as the user of the site. Both parties accepting them without reservation. In the absence of a contract concluded between the customer and us or of prior expressly written derogations, the orders will be subject to these general conditions regardless of the clauses that may appear on the customer's documents. These general conditions of sale are applicable to individuals and professionals placing an order on the site.
When ordering, the customer acknowledges having read the general conditions of sale stated and declares to accept them without reservation.
The site is the complete property of Mr. Lionel GOUPILLE as well as all the rights resulting from its use. Any reproduction, in whole or in part, is systematically subject to the authorization of Mr. Lionel GOUPILLE. The abuse of alcoholic beverages is dangerous for health; it is the customer's responsibility to consume it in moderation. Only a person authorized by law to consume alcohol can contract with “aperosympa.fr”.
Application of the general conditions of sale
In the absence of any specific stipulation in these conditions and agreed in writing between the parties, orders are automatically subject to the general conditions of sale, set out below on electronic media, regardless of the clauses that may appear on the documents of the buyer. Placing an order by this means implies full and unreserved acceptance by the buyer of these general conditions of sale, to the exclusion of all other documents.
Orders
To place an order the customer must identify himself.
A form will be made available to him and he will complete it by indicating the information necessary for his identification and in particular his: surname, first name, telephone number, postal address (especially in the case of a delivery). Additional information may be requested later to ensure the quality and security of the delivery. The buyer is liable for all the consequences attributable to the information he has given when taking the order. In case of erroneous information in the wording of one of the information, the company "aperosympa.fr" can not be held responsible for the impossibility in which it could be to deliver the product. Merchandise not received by the customer within a reasonable time will be returned to the company “aperosympa.fr” and will be made available or else forwarded at the buyer's expense.
After having chosen his products, the customer confirms his order by clicking on the button "Validate the order". He will therefore definitively validate his order by demonstrating his commitment and his acceptance of the General Conditions of Sale. An order identifier number is then communicated to the customer as well as a confirmation on the screen and by e-mail. Confirmation of the customer's data registered by the company "aperosympa.fr" constitutes proof of the nature, content and date of the order.
The sale will only be concluded once the order has been confirmed. The company "aperosympa.fr" reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order.
Products
The products are deliverable within the limit of available stocks and dispatched according to the order of arrival of the orders. In the event of a shortage, the company "aperosympa.fr" will offer an equivalent product (in price and/or value), the buyer is free to refuse this offer, in which case the sale of this product will be cancelled.
The company "aperosympa.fr" remains at the service of its customers to advise them based on its knowledge of the product and its subjective assessment criteria. The final choice, however, is up to the customer. The advice provided cannot under any circumstances be the subject of a complaint.
Product availability
Our product offers displayed on the site are valid for stock subject to shortage due to high demand. Upon receipt of your order, we check the availability of the product(s) ordered. In the event of an order for an unavailable product, the customer will be informed via his customer account available on the site and/or by e-mail as soon as possible.
Product prices
The prices of each product are net, in euros, all taxes included, excluding shipping costs. They are subject to revision at any time and without notice. The articles are invoiced in euros on the basis of the prices indicated on the site at the time of the order. The final price of the order includes the price of the products with VAT as well as the transport and packaging costs.
The price is payable in cash on the day of the order. The prices charged are those applied at the time of the order within the limits of available stocks and subject to typographical error or modification of the French VAT rate. Any change in this rate would then be reflected immediately in the selling prices. The customer will be informed before any delivery; it will be up to him to say by any means, and in particular by e-mail, whether he maintains his order or not.
These conditions apply to shipments to mainland France. For any international shipment, you must request confirmation by email from the company "aperosympa.fr" for the processing of duties and taxes. Payment must be made in full as soon as your order is entered on our site.
Shipping costs and delivery times
Shipping costs are the responsibility of the customer. They are indicated when the order is registered by the latter, who is therefore deemed to have accepted them irrevocably. They are invoiced in addition to the price of the products according to the characteristics of the weight of the products and the characteristics of routing (express or Colissimo, the company "aperosympa.fr" has chosen: the Colissimo offer is based on the weight of your order according to the pricing of the Post Office This offer has a parcel number which allows you to follow the delivery of the latter.
The delivery period does not begin to run until the date of receipt of the order confirmation generated by the site. If the article ordered is available in stock, the delay is approximately 10 days.
In the event of force majeure or exceptional events (climatic events, strikes, riots, civil war, etc.) delaying or prohibiting the delivery of the goods, the company "aperosympa.fr" is released from all liability.
In all cases, delivery on time can only take place if the customer is up to date with his obligations towards the company “aperosympa.fr”. For any urgent delivery request, you must contact the company "aperosympa.fr" by email or telephone.
Payment
The price invoiced to the customer is the price indicated on the order confirmation sent by the company “aperosympa.fr”. The price of the products is payable in cash on the day of the actual order. The order validated by the customer will only be considered effective when the bank payment centers concerned have given their agreement. In case of refusal of the said centers, the order will be automatically cancelled. Furthermore, the company reserves the right to refuse any order from a customer with whom an ongoing dispute exists.
A detailed invoice will be sent to the customer in his package. The indication of the amount of the VAT gives the possibility to the communities, companies and liberal professions to recover it.
Payment method
The buyer guarantees to the seller that he has all the necessary authorizations to use the means of payment he has chosen when registering the order form. The buyer can then pay for his order by: Credit card on the seller's site: In order to ensure the security of payment by credit card, these payments will be made through the secure system. These systems use the SSL (Secure Socket Layer) protocol to transport bank details.
The information transmitted is therefore encrypted by software and no third party can read it during transport on the network. The bank card used for payment of the order will be debited at the time of the order.
By check following an order issued on the site, the order will be processed once the buyer's bank has credited the payment to the seller's bank account. Only checks denominated in euros and written in French will be accepted. The buyer must make out his check in the name of the seller and affix his order number to the back of the check. This check must be sent to the address indicated during the ordering process. A check not received within 10 days of placing an order on the site will result in the cancellation of the current order. The seller reserves the right to request a photocopy of the buyer's identity document. At the Buyer's request, he will be sent a paper invoice showing the VAT.
Dispatch

The transfer of risk of loss or deterioration of the products will be effective once the customer or his representative has signed the delivery slip. Disputes
The company "aperosympa.fr" cannot be held responsible for damage of any kind, whether material, immaterial or bodily, which could result from a malfunction or misuse of the products marketed.
Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer should first contact the company “aperosympa.fr” to obtain an amicable solution.
E-commerce fees
The rates for miscellaneous administrative costs related to e-commerce are as follows:

Recovery: 40 € plus interest and any other costs

Data confidentiality
The personal data provided by the customer is not disseminated to third parties, with the exception of the company "aperosympa.fr" for the security and insurance of payments. Details about your order:
Return costs are the responsibility of the customer. In accordance with Article L. 121-21 of the Consumer Code, the customer has a withdrawal period of 14 (fourteen) clear days for any order placed on www.aperosympa.fr, from receipt of the goods. by the consumer himself or a third party, other than the carrier, designated by him. Exercising this right does not entail any penalty.
Method of withdrawal and return of products
Before the expiry of the 14-day withdrawal period, the customer must send his request for withdrawal by email or post to the company aperosympa.fr. Returns must be made in their original condition and complete, allowing their "remarketing" in new condition, and accompanied by a copy of the purchase invoice for optimized management, to the address indicated below. . The consumer must return the goods to aperosympa.fr, at the latest within 14 days following the sending of his decision to withdraw. If, for any reason, you wish to withdraw from your purchase, you can inform us of your decision within 14 days of receiving the products. We will refund the amount of the item. The costs of returning products remain the responsibility of the customer.
